Official Rules for Weekly Giveaways

To be eligible to win, you must agree to these terms.

1. Can I participate?

The Weekly Giveaways from KicksOnFire.com x BNYCOnline.com are open to all legal residents of the fifty (50) United States and the District of Columbia who are 13 years or older and are registered to the KicksOnFire.com newsletter and BNYCOnline.com, except as provided in paragraph 6 below.

2. How do I enter?

This promotion begins on April 1, 2008, every friday until notified exclusively by sponsors. To enter:

Entries must be received by 11:59 p.m. EST on thursday of every week. Limit one entry per person regardless of method of entry. Multiple entries submitted by a single entrant are void. Misdirected, lost, late, inaccurate, incomplete, mutilated or illegible entries are not the responsibility of the Sponsor, and are void. False or deceptive entries or acts will render the entrant ineligible. All entries become the property of the Sponsor and will neither be returned nor acknowledged.

3. What can I win?

One person per week will be selected to win a single pair of shoes chosen by KicksOnFire.com and BNYCOnline.com (approximate retail value $50 – $200). No substitution or transfer of prize or cash redemption is permitted, but Sponsor may at its option substitute cash value or another prize it believes is of equal or greater value.

4. How do I win?

Each prize winner each week will be determined by a random drawing from all entries within the newsletter / customer pool of KicksOnFire.com and BNYCOnline.com. As long as a entrant is signed up to the KicksOnFire newsletter and on BNYCOnline, the entrant will be included in all future giveaways unless they wish to unsubscribe which accounts for a withdrawal on the entrants part.

5. How do I find out if I won?

Each potential prize winner will be notified by either phone or email within approximately seven days from the date of the drawing. Any potential prize winner who declines to accept the prize, has violated any of these Official Rules, does not respond to the award notification by the date listed on the notification, or is found to be ineligible will be disqualified and an alternative prize winner shall be chosen. Each potential winner releases Sponsor , their affiliated companies and all employees, agents, and representatives from all liability and responsibility of any kind which is related in any way to the prize (including without limitation any property loss, damage, personal injury or death) and the consent to the use of their names and likenesses for advertising and promotional purposes without additional compensation, except where prohibited by law.

6. Who can’t participate?

Employees, their immediate families, and persons living in the same household as employees of Sponsor, their affiliated companies and all associated advertising and promotion agencies of each and suppliers of the prizes for this promotion are not eligible to win.

7. General Conditions.

Void where prohibited. This contest is subject to all applicable Federal, States and local laws and regulations. By entering, each entrant agrees to be bound by these Official Rules and the decisions of Sponsor, whose decisions are final and binding with respect to all matters related to this promotion. Sponsor is not responsible for any printing errors in these Official Rules.

9. How will disputes be handled?

Each entrant agrees that (1) any and all disputes, claims, and causes of action arising out of or in connection with this promotion, or any prizes awarded, shall be resolved individually , without resort to any form of class action, and any judicial proceeding shall take place in a Federal or State Court within the state of New York.; (2) any and all claims, judgments, and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this promotion, but in no event attorneys’ fees; and (3) under no circumstances will entrant be permitted to obtain awards for, and entrant herby waives all right to claim punitive, incidental, and consequential damages, and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of entrant and Sponsor in connection with this promotion, shall be governed by, and construed in accordance with the laws of the State of New York, without giving effect to any choice of law or conflict of law rules or provisions (wether of the State of New York or any other jurisdiction), that would cause the application of the laws of the jurisdiction other than the State of New York.

This promotion is sponsored by KicksOnFire.com and BNYCOnline.com. Sponsors reserve the right to modify or cancel this promotion at any time and, in the event of cancellation, substitue another in its place.
